Hellooooooo gamers! I'm Grimm(he/him). Still figuring out how I want to proceed on Twitch but looking forward to streaming games and art! There will be scuff, there will be chaos, I cannot promise I will not troll you- I'm having fun with it, and hope you all do too!I'm going to try and stream everyday, but times will be when I feel like it, and possibly at weird hours. Terms of Service.
General:
✦ Merchandising rights should be discussed when inquiring about a quote, not after the work is finished. Merchandising rights may be purchased later, but may be subject to higher fees.✦ Clients are required to credit for my work. For VTuber character design, model art, or model rigging, you must credit me visibly in your social media bio. For art, please credit me under the post. For all other assets, a credit on a website, carrd, or blog page will suffice.✦ Do not resell my art.✦ Do not try to claim my art as your own.✦ My art may not be used for NFTs, or AI training, so do not bother asking. If you intentionally use my art for either, I reserve the right to blacklist you from future services and pursue legal action.✦ I provide a version of illustrations without a signature for making graphics or for personal use. If posting my art publicly, you MUST use the version with my signature, and make sure it is visible.✦ You may not pay another artist to edit or complete my work unless it is agreed upon during the initial inquiry.✦ In the instance of character design, you may not publicly redesign the character until after I have delivered and posted the final product.✦ My art may not be used to perpetuate racism, ableism, antisemitism, transphobia, homophobia, or any other form of actions driven by hate for marginalized groups.
Payments:
✦ 20% of the full payment is due up front as a non refundable fee to reserve a commission slot. After the sketch is completed, the remaining balance will be due before I begin working on the final project. For rigging, remaining payment is due before I begin importing the files into Live2d.✦ If the commission value is over $250, it may be split into multiple payments. A minimum of 50% must be paid after the completion of the sketch for Live2D or commercial use art.✦ All payments must be completed before the final files are sent.✦ Limited time bundles, specials, discounts, or promotional purchases must be paid for up front.
Revisions:
✦ I will check in at the end of each stage in the project. For art, these are sketch, lineart, rendering, and background. For rigging, these are face rigging, face XYZ, head XYZ with physics, body xyz, and toggles/extras. During each stage, clients will be given one chance to inform me of any small adjustments that must be made. Once I have confirmed it looks good and moved to the next stage, additional changes are subject to fees.✦ However, changes that require me to redo a bulk of work on any stage are subject to fees based on the percentage of work I need to redo.✦ Revisions for rigging errors on my part are always free, no matter when they are noticed.✦ For Skeb style commissions, I will check in once per week with proof of work being done, but otherwise will not accept any changes or adjustments.
Deadlines and Delivery:
✦ Deadlines will vary based on the project.✦ I will typically give a very broad range of time for delivery in order to account for my unpredictable health, but delivery is usually somewhere in the middle of this range.
Live2D:
✦ You may not make merch using Live2D model art, or a model I have rigged; separate merchandising rights must be discussed and purchased.✦ Live2D models may be resold to a new owner in the instance of a rebrand, however, the price must not exceed 80% of what was initially paid.✦ Streaming assets which I have made such as emotes, alerts, backgrounds, or overlays may be bundled with a model resale, but must NOT contribute to the final price.✦ Model or character design credit must be clearly visible in the bios of all active social media pages.✦ You may not use a Live2D model created by me to enact harmful behaviors such as harassment, bullying, or abuse.
Refunds:
✦ My work and time is non-refundable. In the case that I cannot complete the work, I will issue a partial refund based on how much work was already done, and deliver what unfinished files were worked on to that point.
Communication:
✦ I prefer to communicate via discord, but can also be reached on Twitter.✦ Check-ins will occur weekly, Fri-Sun, as well as anytime a milestone is reached. In the instance that I miss a check-in, please do reach out for an update! I have really bad memory issues due to disability, and survive off to-do lists, so I'm always grateful for the extra nudge if I forget something.✦ You can absolutely message me anytime on Discord/Twitter if you have questions or concerns. Or just want to send me memes. I love when clients send memes...
Rights Reserved:
✦ I reserve the right to reject or deny a commission inquiry for any reason.✦ I retain the right to use my art for advertising my work, for my portfolio, and for content on my own social media pages, after the contract period is completed.✦ If a commission needs to be kept secret, I should be informed during the inquiry process. Depending on the length of secrecy, I may charge additional fees. Otherwise, I reserve the right to stream my work process onto my twitch and YouTube channels, respectively.✦ I reserve the right to issue a partial refund at any point if I am uncomfortable or unable to complete the work. Refunds will always be based on how much work I have done.✦ I reserve the right to reclaim a character design that I myself created in the sole instance that the VTuber representing the design is using my work to spread extreme hate or to commit crimes.
